Terms and Conditions Carl Hanser Verlag GmbH & Co. KG

1. Scope

The business relationship between Carl Hanser Verlag GmbH & Co. KG (P.O. Box 86 04 20, 81631 Munich) and you is governed exclusively by these General Terms and Conditions in the version valid at the time of the order. You can download the General Terms and Conditions to your computer or print them out. We only recognize deviating provisions if we have expressly agreed to them in writing in advance.

2. Conclusion of contract

Your order constitutes an offer to us to conclude a purchase contract. When you place an order with us, you will receive an email confirming receipt of your order. This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. A purchase contract is only concluded when we ship the ordered product to you.

3. Cancellation

(1) You are no longer bound to your order if you cancel it within two weeks of receiving the goods. No reason is required for cancellation, but it must be declared in writing (e.g., by letter, fax, or other means of text communication) or by returning the goods within two weeks. To meet the deadline, it is sufficient to send the revocation or the goods in good time to:

(2) In the event of revocation, we will refund the purchase price already paid. In the event of withdrawal, you are obliged to return the goods immediately in proper packaging. If you return goods within 14 days from a delivery with a total order value of up to EUR 40, you must bear the costs of the return shipment if the goods delivered correspond to those ordered. Otherwise, the return shipment within 14 days is free of charge for you. Until you exercise your right of withdrawal, you are entitled to remove the delivered goods from their packaging to check that they are free of defects and to carry out any necessary inspection of the goods. If you use the goods beyond this, we reserve the right to charge you for the reduction in value of the goods, including any reduction in value resulting from normal use.

(3) If the goods have already been used and show signs of wear, the purchase can also be revoked within 14 days of delivery; however, we reserve the right to charge the customer for the depreciation or value of the use of the goods. In the case of sealed CDs, DVDs, video films, or software, the right of revocation expires if the goods have been opened by the customer.

4. Prices, delivery, and shipping costs

(1) The prices valid at the time of ordering apply. Our prices are final prices in US dollars. They include the statutory value-added tax.

(2) We deliver the ordered goods to the delivery address you specify. Information about the delivery period is non-binding, unless, in exceptional cases, the delivery date has been expressly confirmed as binding.

(3) The following flat rates for packaging and shipping within Germany apply, depending on the order value:
up to 49 euros = 2.90 euros, from 49 euros = 3.90 euros, from 59 euros = 4.90 euros, from 69 euros = 5.90 euros, from 99 euros = 6.90 euros, from 129 euros = 7.90 euros, from 149 euros = 8.90 euros.
For international shipments, we charge the actual shipping costs incurred.

(4) The delivery obligation is subject to the availability of the goods. If the ordered work has not yet been published, the order will be placed on hold. In the case of out-of-print works, you have the choice of canceling your order or placing an order for a possible reprint or new edition. In any case, you will be informed immediately of the unavailability of an item.

5. Terms of payment and retention of title

(1) The purchase price is due immediately and payable without deduction. You can pay by bank transfer.

(2) In the event of late payment, we are entitled to charge interest on arrears at a rate of 5% above the base rate announced by the Deutsche Bundesbank. The assertion of further damages caused by default remains unaffected.

(3) The delivered goods remain our property until full payment has been received.

6. Warranty and liability

(1) If the purchased item is defective, you may choose to request either rectification of the defect or replacement delivery. We may refuse to provide a replacement delivery or remedy the defect if this would only be possible at disproportionate cost, or if it would be delayed beyond a reasonable period for reasons for which we are responsible, or if the remedy of the defect or replacement delivery fails in any other way. In such cases, you are entitled to withdraw from the contract and demand a corresponding reduction in the purchase price.

(2) The statutory warranty period applies. If you are not a consumer, a warranty period of one year from delivery of the goods applies.

(3) We shall be liable for damages caused by us in the event of a breach of the main contractual obligations and in the absence of a warranted characteristic of the goods. Beyond that, we shall only be liable in accordance with the Product Liability Act. Liability for the breach of secondary contractual obligations is excluded, unless the damage was caused by us or our agents through gross negligence or intent. In the event of a slightly negligent breach of a primary contractual obligation, we shall be liable for typically foreseeable damage up to the amount of the purchase price of the goods ordered.

7. Data protection

We store your personal data for order processing and may pass it on to third parties for this purpose. In addition, we exchange data with credit agencies and the General Credit Protection Association (Schufa) for the purpose of credit checks where we have a legitimate interest. Data processing is carried out in accordance with the applicable Federal Data Protection Act.

8. Place of jurisdiction

The place of performance is Munich. The place of jurisdiction for transactions with merchants, legal entities under public law, or special funds under public law is also Munich.

9. Severability clause

Should one or more provisions of these general terms and conditions be invalid, the general statutory provisions shall apply in their place. The partial invalidity of individual provisions shall not affect the validity of the remaining provisions of these general terms and conditions.

Subscription terms for specialist journals:

  • The subscription period is one year. The subscription is automatically renewed for another year unless it is canceled in writing at least six weeks before the end of the subscription year.

  • The subscription price consists of the subscription fee and postage and shipping costs. The respective costs are listed individually on our website.

  • Value added tax is shown separately on your invoice.
